قواعد ولوائح فتنس سنتر/ حيم

The Fitness Centre located in Al Manara Road, Al Quoz 1, Dubai, UAE is intended for the exclusive use of the members (herein called the “members”) of Befit Sports Club Civil Company (herein called the “Fitness Centre”). Non-members are not allowed to access and use the equipment.

يعتبر مركز فتنس سنتر، الكائن في شارع المنارة، القوز 1، دبي – الإمارات العربية المتحدة، مخصص للاستخدام الحصري لأعضاء (المشار إليهم هنا فيما بعد لفظًا بلقب “الأعضاء”) الشركة المدنية لنادي بيفيت للألعاب الرياضية (المشار إليها هنا فيما بعد لفظًا بلقب “فتنس سنتر”). لا يسمح لغير الأعضاء الدخول إلى المركز واستخدام المعدات.

• • The Fitness Centre opens from 6 a.m. to 11 p.m, 7 days a week. The Fitness Centre reserves the right to vary opening times at its discretion
• يعمل فتنس سنتر من الساعة 06:00 ص إلى الساعة 11:00 م، 7 أيام في الأسبوع. يحتفظ فتنس سنتر بحق تغيير مواعبد العمل بموجب تقديره وتقريره المطلق.

• The Fitness Centre reserves the right to suspend the use of any facilities at any time for the organization of private classes and activities or for the arrangement of maintenance, repair or cleaning without prior notice and without refund or other consideration to members for loss of use of the facility.

• يحتفظ فتنس سنتر بحق تعليق استخدام أي مرافق في أي وقت لتأسيس الدروس والأنشطة الخاصة أو لترتيب إجراء أعمال صيانة أو إصلاحات أو تنظيف دون سابق إخطار ودون رد أو تعويض للأعضاء عن أي خسارة عن استخدام المرفق.

• • The Fitness Centre may cease providing all facilities, and services to all members upon the Fitness Center’s giving one-month written notice of cessation and promptly refunding all advance monthly or annual fees previously paid by members with respect to future months.
• يحق لفتنس سنتر التوقف عن تقديم كافة المرافق والخدمات لكافة الأعضاء بتقديم إخطار خطي مسبق بمدة شهر يفيد بوقف والاسترداد الفوري لكافة الرسوم الشهرية أو السنوية المدفوعة مقدمًا من قبل الأعضاء نظير الشهور القادمة.

Dress Code:

قواعد الزي المناسب:  

• • All members should wear appropriate apparel and footwear to comply with the requirements of the Fitness Centre, otherwise the access to and use of such facilities will be refused.
• يتعين على جميع الأعضاء ارتداء الملابس والأحذية المناسبة للامتثال لمتطلبات فتنس سنتر وإلا لن يسمح بدخولهم واستخدامهم لهذه المرافق.
• • Maintenance of clean clothing and personal hygiene is extremely important and is strongly encouraged for the benefit and safety of all members. Please do not leave soiled exercise clothing overnight in private lockers.
• يعد الحفاظ على ارتداء ملابس نظيفة والحفاظ على النظافة الشخصية أمرًا في غاية الأهمية ويتم التشجيع عليه بشدة لمصلحة وسلامة جميع الأعضاء. يرجى عدم ترك ملابس التمرين المتسخة في الخزائن الخاصة ليلًا.

Access to Fitness Centre:

الدخول إلى فتنس سنتر

• • The Fitness Centre is for the entry and use of persons of the age of 18 or above only.
• يعد فتنس سنتر مخصصًا لدخول واستخدام الأشخاص من سن 18 عام فما فوق فقط.

• Persons under 18 years of age must be accompanied at all times by an adult to use the Fitness Centre.

• يجب أن يكون الأشخاص الذين هم أقل من 18 عام بصحبة شخص بالغ في جميع الأوقات لاستخدام فتنس سنتر.

• If you are under the age of 18, you will not able to register on our website – your registration must be done in person at our reception.
• إذا كان عمرك أقل من 18 سنة، فإنك لن تتمكن من التسجيل على الموقع الخاص بنا – ويلزمك إجراء التسجيل بصفة شخصية في مقر الإستقبال الخاص بنا. 

• • Presence in the fitness area is limited to the use of the equipment for Fitness Centre/fitness purposes. People who are not making use of the Fitness Centre are not allowed in the area.

• يكون الحضور في منطقة اللياقة قاصرًا على استخدام معدات فتنس سنتر/ لأغراض اللياقة. لا يسمح للأشخاص التي تستفيد من فتنس سنتر بالتواجد في المنطقة.

• The Fitness Centre reserves the right to refuse entry in excess of the permitted maximum number.

• يحتفظ فتنس سنتر بحق رفض دخول الأشخاص المتجاوزين للحد الأدنى المسموح به.

COVID-19 PRECAUTIONARY MEASURES

إرشادات مكافحة كوفيد–19

1. As a member, you will follow all precautionary measures to combat Covid-19.

 بصفتك عضو، عليك الالتزام باتباع كل التدابير الاحترازية لمكافحة كوفيد-19

2. You must wear your mask at all times. Masks can be lowered while engaged in strenuous physical exercise.

يجب عليك ارتداء الكمامة طوال الوقت. يمكن إنزال الكمامة عند ممارسة تمارين بدنية شاقة.

3. Follow social distancing – please keep at least 2 meters of social distancing.

التزم بالتباعد الاجتماعي – حافظ على مسافة مترين من الآخرين.

4. Use the booking system on the app to book your gym access. You must present this to reception upon arrival to show that you have booked a time slot. You will be asked to wait if it is not your time slot or turned away if you have passed your time slot.
5. استخدم نظام الحجز من التطبيق لحجز دخولك للصالة الرياضية. ويطلب منك إظهار تأكيد الحجز لمكتب الاستقبال عند الوصول. سيطلب منك الانتظار في حال وصولك في غير وقت حجزك أو يتم رفض دخولك في حال تجاوزت وقت حجزك.

Memberships:

• • The Fitness Center may modify and establish categories of membership.
• يحق لفتنس سنتر تعديل وتحديد فئات العضوية.
•  
• • Members may temporarily suspend their membership for up to 4 (four) weeks for major medical reasons. Appropriate medical documentation is required. (For yearly memberships only.)

• يجوز للأعضاء تعليق عضويتهم مؤقتًا لمدة تصل إلى 4 (أربعة) أسابيع لأسباب طبية رئيسية. تقديم الوثائق الطبية مطلوبًا .(للعضويات السنوية فقط.)

• •Faceless memberships are for specific group classes only and they are not meant to be used for personal training sessions.
• تكون عضويات مجهولي الهوية مخصصة لفصول مجموعات محددة ولا يتم استخدامها لجلسات التدريب الشخصية.

TRANSFER OF MEMBERSHIP BY MEMBER

نقل العضوية من قبل العضو

• • Members may transfer their membership to another person, as long as they are not yet in our database. A 300aed transfer fee will apply.
• يجوز للأعضاء نقل عضويتهم للغير من الأشخاص لا طالما لم يتم بعد إدراجهم في قائمة البيانات الخاصة بنا مع دفع رسوم نقل عضوية قيمتها 300 درهم إماراتي.

CANCELLATION OF MEMBERSHIP BY FITNESS CENTRE FOR CAUSE

إلغاء العضوية من قبل فتنس سنتر لسبب:

• • The Fitness Center may cancel the membership of any member whose account or any portion thereof includes any amounts due and unpaid for more than thirty (30) days.
• يحق لفتنس سنتر إلغاء عضوية أي عضو يتضمن حسابه أو أي جزء منه أي مبالغ مستحقة وغير مسددة لأكثر من ثلاثين (30) يومًا.

• • Any member may also be expelled by the Fitness Center without refund for repeated violations of any rules and regulations, or any conduct which, in the absolute discretion of the Fitness Center, is prejudicial to the welfare, good order, reputation, and character of the Fitness Center.

• يحق أيضًل لفتنس سنتر طرد أي عضو دون استرداد للرسوم في حال المخالفة المتكررة لأي من القوانين واللوائح أو أي سلوك، والذي يموجي تقدير وتقرير فتنس سنتر المطلق، يمس برفاهية ونظام وسمعة وشكل فتنس سنتر.

CANCELLATION OF MEMBERSHIP BY MEMBER

إلغاء العضوية من قبل العضو:

• • Members may cancel their membership with 30 days’ written notice for major medical reasons on provision of appropriate documentation ( with a stamped report from a government hospital). The cancellation request form is available at the Fitness Center. The form must be approved and signed by both parties.
• يحق للأعضاء إلغاء عضويتهم بإخطار خطي مسبق بمدة 30 يومًا لأسباب طبية رئيسية بتقديم وثيقة ملائمة (مع تقرير مختوم من مستشفى حكومي). استمارة طلب الإلغاء متوافرة في فتنس سنتر. يجب اعتماد وتوقيع الاستمارة من قبل الطرفين.

• • If you have paid for your membership in full, you will receive a pro-rated refund less 20% of the remaining balance.
• إذا دفعت رسوم عضويتك بالكامل، ستحصل على استرداد تناسبي بعد خصم 20 % على المبلغ المتبقي.

General Rules and Regulations:

قواعد ولوائح عامة:

• • Persons using the equipment in the Fitness Centre are responsible for their own safety. They are advised to seek advice and assistance from our staff in the Fitness Centre if necessary.
• يتحمل الأشخاص الذين يستخدمون معدات فتنس سنتر مسئولية سلامتهم الشخصية. يٌنصح هؤلاء الأشخاص بطلب المشورة والمساعدة من موظفينا في فتنس سنتر عند اللزوم.

• • All facilities of the Fitness Center are available on a first come first served basis. Participation in classes will be limited; advance sign up may be required.

• تكون جميع مرافق فتنس سنتر متاحة على أساس من يأتي أولًأ يحصل على الخدمة أولًا. ستكون المشاركة في الفصول محدودة؛ قد يلزم التسجيل المسبق لذلك.

• • Please mute mobile phones and pagers while on Fitness Centre.
• يرجى كتم صوت الهواتف المحمولة وأجهزة الاستدعاء عند التواجد في فتنس سنتر.

• • Please do not speak loudly inside the Fitness Centre.
• يرجى عدم التحدث بصوت عال أثناء التواجد في فتنس سنتر.

• • The use of personal towel is required in order to avoid possible contagions and the deterioration of the machines. Once you have finished your session, leave the towel in the basket.
• يكون استخدام المنشفة الشخصية لازمًا لتجنب العدوى المحتملة وتدهور الماكينات. بمجرد انتهاء الجلسة الخاصة بك، ارمي المنشفة الخاصة بك في سلة المهملات.

• • All members are required to follow the instructions of the Fitness Centre staff. In case of any doubt, complaints on using Fitness Centre equipment or equipment breakdowns, we requested that you immediately contact the front desk or the Fitness Centre staff for assistance.

• • Please handle the equipment in the Fitness Centre with care. Members are responsible for any damages caused by misuse of the facilities or equipment.
• يرجى التعامل مع معدات فتنس سنتر بعناية. يتحمل الأعضاء مسئولية أي ضرر يلحق بالمرافق أو المعدات نتيجة لسوء الاستخدام.

• • Members are responsible for their own property and safety. The Fitness Centre management will take no responsibility for the loss, theft or damage of belongings brought into the Fitness Centre by members.
• يتحمل الأعضاء مسئولية سلامة متعلقاتهم. لن تتحمل إدارة فتنس سنتر مسئولية أي خسارة أو سرقة أو تلف لأي من متعلقات الأعضاء.

• • The Fitness Centre management will not be responsible for any injury or death of anyone using the facility.
• لن تتحمل إدارة فتنس سنتر مسئولية إصابة أو وفاة أي شخص يستخدم المرفق.
•  
• • Failure to comply with the above rules may result in loss of Fitness Centre privileges.
• قد يؤدي الإخفاق في الامتثال للقواعد السابقة إلى خسارة امتيازات فتنس سنتر.
•  
• • The Fitness Center reserves the right to revise and add to these rules, regulations, policies and procedures as needed for the benefit, comfort and enjoyment of the members, and the reasonable and proper management of the Fitness Center. All members and their guests shall comply with such revised or additional rules, regulations, policies or procedures.
• يحتفظ فتنس سنتر بحق تعديل وإدراج إضافات على هذه القواعد واللوائح والسياسات والتدابير اللازمة لمصلحة وراحة ورفاهية الأعضاء وللإدارة المعقولة والملائمة لفتنس سنتر. يتعين على جميع الأعضاء وضيوفهم الامتثال للقواعد أو اللوائح أو السياسات أو التدابير المعدلة أو الإضافية.
•  
• •The use of illegal supplements is prohibited in the facilities at all times.
• ممنوع استخدام المكملات الغذائية غير القانونية في المرافق في جميع الأوقات.
•  
• • SEVEN is not responsible for any agreement between members and freelancer personal trainers.
• يكون سفن جيم غير مسئول عن أي اتفاقية تبرم بين الأعضاء والمدربين الشخصيين المستقلين.
•  
• • All yearly members will be given a bracelet for locker access when they sign up to the gym. If the bracelet is damaged or lost, a fee of 200AED will apply.
• سيحصل الأعضاء السنويين على سوار للدخول إلى الخزانة عند التسجيل في صالة الألعاب الرياضية. في حال تلف أو ضياع السواء، عندئذ ستطبق رسوم بواقع 200 درهم.

• • For monthly, daily, APC and Privilee members, a locker card will be provided for their visit. The card should be returned when leaving. If the card is damaged or lost, a fee of 50AED will apply.
• بالنسبة للأعضاء الشهريين أو اليوميين أو الأعضاء المميزين أو أعضاء الـــ APC، سيتم تقديم بطاقة خزانة عند زيارتهم. يجب إعادة البطاقة عند المغادرة. في حال تلف أو ضياع البطاقة، ستطبق رسوم بواقع 50 درهم.
•  
• • Smoking, eating and drinking (except water) is prohibited in the fitness area at all times.
• ممنوع التدخين وتناول الأطعمة والمشروبات (باستثناء المياه) داخل منطقة اللياقة في جميع الأوقات.
•  
• • For the safety of all members, please refrain from preventing or interfering others’ use of the equipment in the Fitness Centre.
• لسلامة جميع الأعضاء، يرجى الامتناع عن منع أو التدال مع استخدام الآخرين لمعدات فتنس سنتر.
•  
• • For the benefit of all, it is requested that you return equipment to the corresponding place when finished.
• لمصلحة الجميع، يرجى من سيادتكم إعادة المعدات إلى مكانها الصحيح عند الانتهاء من استخدامها.
•  
• • Except in respect of the Fitness Centre’s activities, no commercial or religious activities are allowed in the Fitness Centre without prior written approval from the Fitness Centre.
• فيما عدا ما يتعلق بأنشطة فتنس سنتر، لا يسمح بإجراء أي أنشطة تجارية أو دينية في فتنس سنتر ما لم يتم الحصول على موافقة خطية مسبقة من فتنس سنتر.

• • Private coaching, assessments and other related activities are not allowed in all venues without prior written authorization from the Fitness Centre.
• لا يسمح بالتدريب والتقييمات الخاصة والأنشطة الأخرى ذات الصلة في جميع الأماكن دون مواففة خطية مسبقة من فتنس سنتر.

FEES AND CHARGES

الرسوم والتكاليف

1. All published membership or other fees and other charges are inclusive of any taxes (e.g. VAT). BEFIT SPORTS CLUB TRN number is 100319017800003 and this applies to all charges from BEFIT SPORTS CLUB applied under these Terms and Conditions. Your VAT invoice for any monthly memberships or other fees or charges is available for you to collect from the gym reception and it will be automatically sent to you by email.

تشمل كافة رسوم العضوية والرسوم والتكاليف الأخرى المعلنة أي ضرائب (مثل: ضريبة القيمة المضافة) والرقم الضريبي لنادي بي فيت الرياضي هو 100319017800003 وينطبق هذا على كافة التكاليف المطبقة من نادي بي فيت الرياضي بموجب هذه الشروط والأحكام. من المتاح بالنسبة لك تحصيل فاتورة ضريبة القيمة المضافة لأي عضويات شهرية أو غيرها من الرسوم والتكاليف في مقر الاستقبال بصالة الألعاب الرياضية وسيتم إرسالها إليكم تلقائيًا عبر البريد الالكتروني. 

2. There are two payment options available for yearly memberships: Upfront payment or monthly recurring payment. The “Monthly Recurring Payment” or “Recurring Payment” means that Seven membership fee corresponding to the purchased membership option (e.g. Fixed Term or Flexible), and determined by the membership type and membership term at the point of joining.

هناك خياران للدفع بالنسبة للعضويات السنوية وهما: الدفع المقدم أو الدفع الشهري المتكرر. ويُقصد “بالدفع الشهري المتكرر” أو “الدفع المتكرر” رسوم عضوية سفن المقابلة لخيار العضوية التي تم شرائها (لمدة محددة أو مفتوحة) والمحددة حسب نوع العضوية ومدتها عند الإنضمام. 

3. The monthly membership fee or Monthly Recurring Payment is due each month in full, upfront, in advance and with the exception of cancellations under the terms detailed below, no partial refund of the monthly membership fee will be made unless you are cancelling under cooling-off regulations detailed below.

تكون رسوم العضوية الشهرية أو الدفعة الشهرية المتكررة مستحقة كل شهر بالكامل ومقدمًا مع استثناء أي إلغاءات بموجب الشروط المفصلة أدناه ولن يتم رد أي جزء من رسوم العضوية الشهرية ما لم تقم بالإلغاء بموجب لوائح التهدئة المفصلة أدنا. 

4. Your second Monthly Recurring Payment will be collected one month after you joined unless you joined prior to your gym opening in which case it will be collected one month after the gym has opened. Subsequent Monthly Recurring Payments for monthly membership fees will be collected monthly thereafter.

سيتم تحصيل الدفعة المتكررة الشهرية الثانية بعد شهر من إنضمامك ما لم تنضم قبل إفتتاح صالة الجيم وفي هذه الحالة يتم تحصيلها بعد شهر من إفتتاح صالة الجيم ويتم بعد ذلك تحصيل الدفعات المتكررة الشهرية اللاحقة مقابل رسوم االعضوية الشهرية على أساس شهري. 

5. If any Monthly Recurring Payment is returned unpaid or any cheque is returned unpaid or if any other form of payment is not honoured for whatever reason, your access to the facilities will be refused and you shall pay us on demand an administration fee of AED 200. If, despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole election, either suspend or terminate your membership. If you are ever over 30 days in arrears on a missed monthly payment and you are on a Fixed Term membership then we reserve the right to bill you immediately after the 30 day grace period for the remaining contract value without any prior notification.

في حال رد أي دفعة شهرية متكررة أو أي شيك دون دفع أو عدم الوفاء بأي شكل أخر من أشكال الدفع لأي سبب كان، يتم منعكم من الدخول لأي مرافق وتلتزمون بالدفع لنا عند الطلب رسوم إدارية قيمتها 200 درهم إماراتي. في حال، على الرغم من إخطارنا لك بأي دفعة فائتة، القيام بتفويت مزيد من الدفعات، نحتفظ بحقنا، بناء على إختيارنا الخاص والفردي، بتعليق العضوية الخاصة بك أو إنهائها. إذا تأخرت أكثر من 30 يوم في سداد دفعة شهرية فائتة وكانت لديك عضوية محددة المدة، نحتفظ حينها بحقنا في إصدار فاتورة لكم على الفور بعد مهلة السماح الممتدة إلى 30 يوم  لقيمة العقد المتبقية دون سابق إشعار. 

6. You are obligated to make the minimum number of Monthly Recurring Payments stated in your choice of membership. You are obligated to make every Recurring Payment regardless of non-attendance, except where the cancellation terms below are met.

تلتزم بإجراء الحد الأدنى من عدد الدفعات الشهرية المتكررة المذكورة في خيار العضوية الخاصة  بك مع الالتزام بإجراء كل دفعة متكررة دون النظر إلى عدم المواظبة على الحضور، باستثناء الحالات التي يتم فيها استيفاء شروط الإلغاء أدناه. 

7. The date of your Monthly recurring Payment is likely to be the same date on each month as the first Monthly Recurring Payment. You are unable to amend the date of your Recurring Payment but we reserve the right to amend the date of your Monthly Recurring Payment at our sole discretion.

من المحتمل أن يكون تاريخ الدفع المتكرر الشهري الخاص بك هو نفس التاريخ التي تم فيه إجراء أول دفعة شهرية متكررة. لا يمكنك تعديل تاريخ الدفع المتكرر الخاص بك ولكننا نحتفظ بالحق في تعديل تاريخ دفعتك الشهرية المتكررة وفقًا لتقديرنا الخاص. 

8. Once you have completed the minimum number of Monthly Recurring Payments as stated in your membership choice we will automatically continue collecting Monthly Recurring Payments every month. Your membership will be extended by one month for each payment (“Renewal Period”).

سنواصل تلقائيًا تحصيل الدفعات الشهرية المتكررة كل شهر بمجرد الانتهاء من الحد الأدنى لعدد المدفوعات المتكررة الشهرية كما هو مذكور في اختيار عضويتك وسيتم تمديد عضويتك لمدة شهر واحد لكل دفعة (“فترة التجديد”). 

9. If you have fulfilled your commitment to the membership you have joined, you may prevent the Automatic Renewal Period at any time by visiting the Seven reception and submitting a cancellation request. (A minimum of 30 days notice is required).

إذا كنت قد أوفيت بالتزامك تجاه العضوية التي انضممت إليها، فيمكنك منع فترة التجديد التلقائي في أي وقت من خلال زيارة استقبال سفن وتقديم طلب للإلغاء. (يلزم تقديم إشعار مدته 30 يومًا على الأقل).

10. You agree to advise us immediately of any change to the Members Details provided.

توافق بأن تقوم بتبليغنا على الفور بأي تغيير في تفاصيل الأعضاء المقدمة.

11. You agree to retain a copy of all transaction records and you are responsible for maintaining the confidentiality of this account.

توافق بأن تحتفظ بصورة من جميع سجلات المعاملات وأن تكون مسئولًا عن الحفاظ على سرية هذا الحساب. 

12. All credit/debit cards’ details and personally identifiable information will NOT be stored, sold, shared, rented, or leased to any third parties.

لن يتم تخزين تفاصيل بطاقات الخصم والائتمان أو معلومات الهوية الشخصية أو بيعها أو مشاركتها أو إسنادها للغير. 

13. Seven will not pass any debit/credit card details to third parties

لن يقوم سفن بتمرير أي تفاصيل خاص ببطاقة الخصم والائتمان للغير.

14. Seven takes appropriate steps to ensure data privacy and security including through various hardware and software methodologies. However, (Seven) cannot guarantee the security of any information that is disclosed online

يتخذ سفن الخطوات المناسبة لضمان خصوصية البيانات وأمانها بما في ذلك من خلال منهجيات الأجهزة والبرامج المختلفة. ومع ذلك، لا يمكن لـ (سفن) ضمان أمان أي معلومات يتم الكشف عنها عبر الإنترنت

15. Seven is not responsible for the privacy policies of websites to which it links. If you provide any information to such third parties different rules regarding the collection and use of your personal information may apply. You should contact these entities directly if you have any questions about their use of the information that they collect.

لا يكون سفن مسئولًا عن سياسات الخصوصية الخاصة بالمواقع التي يرتبط بها. إذا قدمت أي معلومات إلى الغير، فقد يتم تطبيق قواعد مختلفة تتعلق بجمع واستخدام معلوماتك الشخصية. يجب عليك الاتصال بهذه الكيانات مباشرة إذا كان لديك أي أسئلة حول استخدامهم للمعلومات التي يجمعونها.

16. The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, the Customers’ are encouraged to frequently visit these sections to be updated about the changes on the website. Modifications will be effective on the day they are posted.

سياسات وشروط وأحكام موقع الويب قد يتم تغييرها أو تحديثها من حين لآخر لتلبية المتطلبات والمعايير. لذلك، يتم تشجيع العملاء على زيارة هذه الأقسام بشكل متكرر لتحديث التغييرات على موقع الويب. ستكون التعديلات سارية المفعول في يوم نشرها.

17. From time to time we may need to increase the price of your membership. We will give you at least 1 full months’ notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules.

من وقت لآخر ، قد نحتاج إلى زيادة سعر عضويتك وسنقوم بمنحك إخطارًا بمدة شهر على الأقل بأي زيادة واردة في الأسعار والتوضيح التام وقتما تصبح الزيادة في الأسعار سارية المفعول ومقدار تكلفة عضويتك بعد الزيادة. خلال هذه الفترة، سيكون لك الحق على النحو المعتاد في إنهاء عضويتك وفقًا لشروط وأحكام وقواعد العضوية.

18. If you fail to pay any amount due under this agreement for a period of more than thirty days, then we may pass the debt to a third-party company for collection or take legal/police action against you. The reasonable and direct costs incurred in employing the third-party company will be borne by you including costs in tracing you if you have changed your address or contact without telling us.

في حال تخلفت عن  دفع أي مبلغ مستحق بموجب هذه الاتفاقية لمدة تزيد عن ثلاثين يومًا، فيجوز لنا تحويل الدين إلى شركة الغير للتحصيل أو اتخاذ إجراء قانوني/ شرطي ضدك  مع تحميلك التكاليف المعقولة والمباشرة المتكبدة في توظيف شركة الغير بما في ذلك تكاليف تعقبك إذا قمت بتغيير عنوانك أو جهة الاتصال الخاصة بك دون إخبارنا.

19. Seven may choose to run “referral” membership promotions whereby gifts or complimentary memberships are provided in return for members referring friends and them joining. Seven management reserve the right to withhold any gift or complimentary Seven access if the referees break the terms and conditions mentioned here including defaulting on a membership payment.

قد يختار سفن تشغيل عروض ترويجية للعضوية “إحالة” حيث يتم تقديم هدايا أو عضويات مجانية مقابل قيام الأعضاء بإحالة الأصدقاء وانضمامهم. تحتفظ إدارة سفن بالحق في حجب أي هدية أو الدخول المجاني لسفن  إذا خالف الأشخاص الذي تم إحالتهم الشروط والأحكام المذكورة هنا بما في ذلك التخلف عن سداد مدفوعات العضوية.

 PAYMENT METHOD

1. We accept payment by Visa or Mastercard debit and credit cards in AED for our memberships and other products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review the respective merchant service provider’s user agreement and privacy policy before entering any transaction.
   

نقبل الدفع ببطاقات الخصم والائتمان فيزا أو ماستركارد بالدرهم الإماراتي للعضويات الخاصة بنا وغيرها من المنتجات والخدمات. تخضع جميع عمليات الشراء عبر الإنترنت أيضًا لشروط وأحكام مزودي الخدمة المعنيين من التجار. يرجى مراجعة اتفاقية المستخدم وسياسة الخصوصية لمزودي الخدمة المعنيين من التجار قبل الدخول في أي معاملة.

2. Should any member forewarn that their membership payment method is to be cancelled and not adequately replaced prior to the completion of a contract, all remaining charges will be liable and charged immediately.

في حال تحذير أي عضو مسبقًا بإلغاء طريقة الدفع لعضويته وعدم استبدالها بشكل مناسب قبل إتمام العقد، يتم حينها الالتزام ببقية الرسوم وتحملها على الفور.

3. Payment confirmation via email to the email address you provide at the point of registration will be issued within 24 hours of successful processing of your payment.

سيتم إصدار تأكيد بالدفع عبر رسالة الكترونية يتم إرسالها على العنوان الالكتروني الذي تقدمه عن التسجيل خلال 24 ساعة من إجراء الدفع بنجاح. 

4. You, as the cardholder, must retain a copy of transaction records and Merchant policies and rules.

يتعين عليك كصاحب بطاقة الإحتفاظ بصورة من سجل المعاملات وسياسات وقوانين التاجر. 

5. You are responsible for maintaining the confidentiality of your membership account and payment details.

يتعين عليك الاحتفاظ بسرية حساب العضوية الخاصة بك وتفاصيل الدفع. 

6. Once a payment card has been replaced by a new one we will charge the new card only. Should however an account go unpaid for a period of 30 days or more we reserve the right to charge any previous payment card on the account, or any linked account, at our sole discretion in order to obtain funds.

بمجر إستبدال بطاقة الدفع بأخرى جديدة، نقوم بفرض الرسوم على بطاقة الدفع  الجديدة فقط وفي حال عدم دفع الحساب لمدة 30 يوم أو أكثر، فإننا نحتفظ بحقنا في فرض الرسوم على بأي بطاقة دفع سابقة عل الحساب أو أي حساب مرتبط، طبقًا لتقديرنا الخاص للحصول على الأموال. 

7. If you join us online and not on the gym premises you have 14 full days to cancel your membership and obtain a full refund, once you have visited us for the first time within these 14 days, you have 24 hours after your first visit to cancel this agreement for any reason.
   

في حال انضممت إلينا عبر الإنترنت وليس في صالة الألعاب الرياضية، يكون لديك حينها 14 يومًا كاملًا لإلغاء عضويتك واسترداد الأموال بالكامل، بمجرد زيارتك لنا لأول مرة خلال هذه الأيام الأربعة عشر، يكون لديك حينها 24 ساعة بعد زيارتك الأولى لإلغاء هذه الاتفاقية لأي سبب من الأسباب.

Facility Use Waiver:

• • Each member must sign an Assumption of Risk, Release and Waiver of Liability and Indemnity Form provided by the Fitness Center before any use of the facilities is allowed.
• يتعين على كل عضو توقيع استمارة تحمل المسئولية وإبراء الذمة وإخلاء المسئولية والتعويض المقدمة من قبل فتنس سنتر قبل السماح باستخدام المرافق.

ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY FORM

استمارة تحمل المسئولية وإبراء الذمة وإخلاء المسئولية والتعويض

• • I, the undersigned, hereby acknowledge and agree that I understand the nature of the activities provided by the Fitness Centre and the manner to use the facilities or equipment available; that I am qualified, in good health, and in proper physical condition to join the Fitness Centre/gym therein; that there are certain inherent risks and dangers associated with the use of the Fitness Centre/gym; and that, except as expressly set forth herein, I, knowingly and voluntarily, accept, and assume responsibility for each of these risks and dangers, and all other risks and dangers that could arise out of, or occur during, my participation in the activities / use of any facilities or equipment of the Fitness Centre.
• أقر وأوافق أنا، الموقع أدناه، على أنني أتفهم طبيعة الأنشطة المقدمة من قبل فتنس سنتر وطريقة استخدام المرافق أو المعدات المتاحة وأنني مؤهل وبصحة جيدة وفي حالة جسدية ملائمة للالتحاق بفتنس سنتر/ الجيم وأن هناك مسئوليات ومخاطر كامنة تتعلق باستخدام فتنس سنتر/ الجيم وأنني، فيما عدا المنصوص عليه صراحة هنا، أقبل صراحة وطواعية مسئولية هذه المخاطر والمسئوليات وجميع المخاطر والمسئوليات الأخرى التي قد تنشأ عن أو أثناء مشاركتي في الأنشطة / استخدام المعدات في فتنس سنتر.

Parents’ Assumption of Risk

• • I agree that the above risks are assumed by me on behalf of any minor child for whom I am responsible and whom I introduce to the Fitness Centre whether accompanied by me or a third party at my request
• أوافق على تحمل المسئوليات السابقة نيابة عن أي طفل قاصر أكون مسئولًا عنه والذي أقدمه إلى فتنس سنتر، سواء بصحبتي أو بصحبة الغير بناء على طلبي.

Release and Waiver

إبراء الذمة والتنازل

• • I, the undersigned, hereby RELEASEE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the Fitness Centre or any representatives, officers and employees thereof (collectively, the “Releasees”), from and for any liability resulting from any personal injury, accident or illness (including death), and/or property loss, however caused, arising from, or in any way related to my participation in the activities / use of facilities or equipment of the Fitness Centre, except for those caused by the willful misconduct, gross negligence or intentional torts of the Releasees, as applicable
• أوافق أنا، الموقع أدناه، بموجبه على التنازل عن وإبراء ذمة وإخلاء مسئولية فتنس سنتر أو أي من ممثليه أو موظفيه أو مسئوليه (المشار إليهم جميعًا هنا فيما بعد بـــ “المعفيون من المسئولية”) من أي من مسئولية تنشأ عن أي إصابة شخصية أو حادث أو مرض (بما في ذلك الوفاة) و/أو خسارة الممتلكات، سواء كان ذلك بسبب أو نتيجة لمشاركتي في الأنشطة/ استخدام المرافق أو المعدات في فتنس سنتر، فيما عدا ما ينتج عن سوء السلوك المتعمد أو الإهمال الجسيم للمعفيين من المسئولية، على النحو المطبق.

Indemnification and Hold Harmless

التعويض وإبراء الذمة

• • I, the undersigned, hereby agree to INDEMNIFY, DEFEND AND HOLD the Releasees HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities including, but not limited to, attorney’s fees, arising from, or in any way related to my participation in the activities / use of facilities or equipment of the Fitness Centre, except for those arising out of the willful misconduct, gross negligence or intentional torts of the Releasees, as applicable
• أوافق أنا، الموقع أدناه، بموجبه على تعويض والدفاع عن وإبراء ذمة فتنس سنتر من أي من وكافة المطالبات والإجراءات والدعاوى والقضايا والتدابير والتكاليف والمصروفات والأضرار والمسئوليات، بما في ذلك، على سبيل المثال لا الحصر، أتعاب المحاماه، الناتجة عن أو المتعلقة بأي شكل من الأشكال من مشاركتي في الأنشطة أو استخدام المرافق أو المعدات في فتنس سنتر، فيما عدا ما ينتج عن سوء السلوك المتعمد أو الإهمال الجسيم للمعفيين من المسئولية، على النحو المطبق.

• • I agree that the above release, waiver and indemnity are given by me on behalf of any minor child for whom I am responsible and whom I introduce to the Fitness Centre, whether accompanied by me or a third party at my request
• أوافق على أن إخلاء المسئولية والتنازل والتعويض الوارد إعلاه قد تم تقديمه بواستطي نيابة عن أي طفل قاصر أكون مسئولًا عنه والذي أقدمه إلى فتنس سنتر، سواء بصحبتي أو بصحبة الغير بناء على طلبي.

Severability

التطبيق الجزئي والفصل بين الأحكام

• • I, the undersigned, expressly agree that the foregoing assumption of risk, release and waiver of liability and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the emirate of Dubai in the United Arab Emirates and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
• أوافق أنا، الموقع أدناه، صراحة على أن تحمل المسئولية وإبراء الذمة وإخلاء المسئولية واتفاقية التعويض السابقة يتم تفسيرها على نطاق واسع وشامل طبقًا للقانون المعمول به في دولة الإمارات العربية المتحدة وإذا أصبح أي بند فيها غير صاريًا، من المتفق عليه أن باقي البنود تظل سارية ونافذة كما هي دون تغيير.

Photo Release Form

استمارة إخلاء مسئولية الصورة

• • I hereby grant permission to Seven Gym to use photographs and/or video of me taken at Seven Gym in publications, news releases, online, and in other communications releases, online, and in other communications related to the mission of Seven Gym.
• أقدم بموجبه تصريح إلى سفن جيم لاستخدام الصور و/أو مقاطع الفيديو المصورة في سفن جيم لأغراض الدعاية والإعلان والتصريحات الصحفية وفي المراسلات الأخرى وعبر الانترنت وفي المراسلات الأخرى ذات الصلة بمهمة سفن جيم.

PRICE PROTECTION

حماية الرسوم:

• Your current membership fee will remain price protected for a period of 7 days after your membership expiry date
• سعر الاشتراك المدفوع سيظل بدون تغيير لمدة ٧ أيام فقط بعد نهاية الاشتراك .

By signing below, I certify that I have read this assumption of risk, release and waiver of liability and indemnity agreement, and have had the opportunity to ask questions about the same. I fully understand that the terms of this assumption of risk, release and waiver of liability and indemnity agreement are binding, and I confirm that I am signing this agreement freely and voluntarily

بالتوقيع أدناه، أقر بأنني قرأت تحمل المسئولية وإبراء الذمة وإخلاء المسئولية واتفاقية التعويض هذه وأقر بأنني قد أتيحت لي فرصة طرح الأسئلة بخصوصها. أتفهم تمامًا أن شروط تحمل المسئولية وإبراء الذمة وإخلاء المسئولية واتفاقية التعويض هذه تكون ملزمة وأؤكد على توقيع هذه الاتفاقية بمحض إرادتي الحرة.
